Halle Berry’s ex-boyfriend, Gabriel Aubry oddly decided to give thanks behind bars this Thanksgiving Holiday. Barry’s ex was arrested this morning after picking a fight with Halle’s fiancé Olivier Martinez, who proceeded to give her ex a shellacking he certainly didn’t expect.
The fight broke out between the men at Berry’s home just before 10 a.m. according to ABC News station KABC in Los Angeles.
According to TMZ, Aubry showed up on Berry’s doorstep with their 4-year-old daughter, Nahla, for a custodial hand-off and flipped out when her fiancé, actor Olivier Martinez, made the comment, “We have to move on,” a possible reference to the recent custody battle which blocked Halle from moving to France with Nahla.
Aubry allegedly pushed Martinez and threw a punch at his face, striking him in the shoulder, TMZ reported.
Berry says she saw the beginning of the fight when Aubry pushed Martinez, according to KABC, and then she left to call 911. Berry and Aubry’s daughter, Nahla, 4, did not witness any of the fight.
Sources told TMZ the fight was ‘brutal’ with the website describing a blow-by-blow account of the encounter: Martinez blocked [Aubry’s punch] and the punch struck him in the shoulder instead… Aubry then pushed Martinez to the ground, a struggle ensued, ending when Olivier courageously ended up pinning Aubry to the ground, an unidentified source told TMZ.
Police were called to the home and transported Aubry to Cedars Sinai Medical Center in L.A. for his injuries after suffering a broken rib, bruises to the face and a possible more serious head injury, TMZ reports.
After the hospital treatment, police held Aubry on a charge of misdemeanor battery, with bail set at $20,000, according to Los Angeles Police Sgt. Mike Odle.
The 46-year-old Berry recently endured a difficult custody battle with the 36-year-old Aubry.
Martinez, who has apparently become increasingly bitter during the custody battle, is said to be interested in pressing charges, TMZ reports.
Martinez, who had a possible broken hand and neck injuries, arrived at Cedars Sinai Medical Center for treatment. Aubry was still receiving treatment at the time.
According to TMZ, details about the argument are unclear because both men were speaking to one another in French.
Aubry, a French-Canadian model who lives and works in Los Angeles, California had petitioned the court, asking it to prevent Halle’s from going forward with her plans to move their daughter to France.
He argued it would give him limited access to his daughter, while Berry countered that the privacy laws are stronger in France, which would keep her daughter safe from the paparazzi so she could live a normal life.
Berry, who split from Aubry in 2010 – had put her wedding plans on hold while she focused on her custody battle.
It’s fairly difficult to understand that just 24 hours earlier, Halle, Oliver and Gabriel had all attended an early Thanksgiving celebration in Los Angeles with Nahla.
While Berry and Martinez picked up Nahla from school and took her to the Thanksgiving party, her father took her home with him on Wednesday.
Emails sent to Berry’s publicist, Meredith O’Sullivan, and Aubry’s family law attorney, Gary Fishbein, were not immediately returned.
The Academy Award winning actress looked strained as she left the event carrying a feathered headpiece and jacket belonging to her daughter.
In her custody battle, Berry claimed that Los Angeles was not the ideal place for her daughter to grow up, due to the persistence of the paparazzi.
The actress has insisted that moving to France was not an attempt to keep Nahla’s father away from participating with raising his daughter.
The Monster’s Ball actress made a telling comment about her custody battle with Gabriel to InStyle magazine this month.
The actress implied that there is chaos, but she believed it would be short lived.
Halle and Gabriel called it quits in April 2010 after more than four years of dating, and she soon began a relationship with actor Martinez. They confirmed their engagement to media outlets in March of 2012.
In another twist, a judge has just issued an emergency protective order – meaning Gabriel has to stay 100 yards away from Halle, Olivier and Nahla.
The order will be valid until Dec. 3.
