Las Vegas: Vehicle Theft and Kidnapping Ends in Fatal Traffic Accident

On Sunday, August 18, 2013 at approximately 11:00 a.m. LVMPD patrol officers responded to the intersection of Flamingo Road and Valley View Boulevard to
investigate reports of a fatal two vehicle accident involving a pickup truck. Arriving officers discovered a deceased adult male who had been ejected from one of the
vehicles and was lying in the roadway. Officers further learned medical personnel had transported the driver of the pickup, along with another individual who had also been ejected from the vehicle, to the UMC Trauma Center.

The investigation into this incident revealed the pickup had been stolen from the East Valet area of the Flamingo Hotel moments before the collision. During that crime two individuals were loading items into the back of the vehicle when the suspect entered the driver’s seat and drove away while both victims were in the bed of the truck. The suspect who has been identified as James Montgomery, 29 years of age of Tustin California, drove Westbound on Flamingo Road with the two victims still in the bed of the truck. Montgomery disregarded a red traffic signal at the intersection of Flamingo Road and Valley View Boulevard striking another vehicle, and causing the two victims in the back of the truck to be ejected onto the roadway. The driver of the vehicle which collided with the stolen pickup was uninjured; however two juvenile passengers were transported by medical personnel to an area hospital with possible minor injuries.

The victim who was deceased at the scene of the accident has been identified by the Clark County Coroner’s Office as Jesus Magdaleno, 33 years of age of California. It
was also learned Magdaleno was an off-duty California Highway Patrol Officer. The second victim who was ejected from the back of the truck, and who was related to the Las Vegas Metropolitan Police Department Office of Public Information

Murder,st Degree kidnapping (2 counts), Robbery (2 counts), Battery resulting in substantial bodily harm, and Grand larceny auto. The investigation into this incident is being conducted jointly by the LVMPD Homicide and Robbery Sections, along with the LVMPD Traffic Bureau, and remains ongoing.
